Notice of Collective Actions Involving DCBFB, LLC

The Attorneys of DeLong, Caldwell, Bridgers, Fitzpatrick, and Benjamin, LLC represent parties in collective actions brought under the Fair Labor Standards Act (29 U.S.C. 216 (b)). Under the FLSA, a collective action may be certified on behalf of similarly situated employees affected by an illegal pay practice. Unlike a “class action”, Members of a class in an FLSA action must “opt in” by returning a “consent” form.

Plaintiff, a former warehouse lead for Defendant, seeks payment for due but unpaid overtime stating that Defendant mislabeled him as an exempt employee, auto-deducted time from his pay, and miscalculated his time sheets by incorrectly rounding its time cards.

Plaintiff, a former server, whom worked in and around Atlanta, Georgia initiated this action on behalf of herself and other similarly situated employees of Defendants seeking payment for due but unpaid minimum wages stating that Defendants required Plaintiff and the class she represents to participate in an illegal tip pool.

U.S. District Court for the Northern District of Georgia
Plaintiff, a former Teller and Night Shift Manager, whom worked in and around Atlanta, Georgia initiated this action on behalf of herself and other similarly situated employees of Defendant seeking payment for due but unpaid minimum wages stating that Defendant required Plaintiff and the class she represents to repay cash drawer shortages plus interest thereby reducing their earnings below the statutory minimum wage.

Consent Order granting Conditional Class Certification approved 10-4-2012.
Class Definition:  All current or former Ackerman employees who worked as tow truck drivers operating from Ackerman’s College Park, Georgia facility at any time from October 26, 2009 through June 26, 2011.

Class Definition:  All current and former A-1 workers who were classified as independent contractors, regardless of job title, who performed any work in the Saalfeld Warehouse in Georgia at any time between September 30, 2008 and the present.
Further Information: The primary Saalfeld Warehouse in Georgia is/was the Saalfeld Redistribution Warehouse, 1780-A Westgate Parkway, Atlanta Georgia 30336 (off Fulton Industrial Blvd, SW, south of I-20 and west of I-285). A1 Quality Labor often used craigslist to recruit workers.
